Terms of Service

Welcome to MythicBrand and The Oracle. These Terms of Service ("Terms") govern your use of magickmaven.com, oracleapp.io, and any related products, services, or content (collectively, the "Services") operated by Krysta Francoeur ("we," "us," or "our"), based in British Columbia, Canada.

By accessing or using our Services, you agree to be bound by these Terms. If you don't agree, please don't use our Services.

1. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Keep your account information up to date
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access at hello@magickmaven.com
  • Be responsible for all activity that occurs under your account

We may suspend or terminate accounts that violate these Terms or are inactive for extended periods.

3. Description of Services

3.1 The Oracle

The Oracle is a digital product that generates personalized readings based on your birth chart data using astrology, Human Design, and Gene Keys frameworks. Some features may require a paid subscription.

3.2 The Oracle Ascended (Subscription)

The Oracle Ascended is a paid subscription that unlocks premium features including:

  • Unlimited "Brainstorm" AI-powered conversations
  • Access to chambers and ongoing content updates
  • Other features as they are released

Subscription pricing, billing frequency, and trial periods are displayed at the point of purchase.

3.3 Free Trial

If you receive a free trial of The Oracle Ascended, you'll have full access to subscription features for the trial period. After the trial ends, you must subscribe to retain access to those features. Your base Oracle reading remains accessible regardless of subscription status.

4. Payment and Subscriptions

4.1 Payment Processing

All payments are processed by Stripe. By providing payment information, you authorize us and Stripe to charge you for the applicable fees.

4.2 Subscription Billing

If you subscribe to The Oracle Ascended:

  • Your payment method will be charged automatically at the start of each billing period (monthly, quarterly, or annually depending on the plan you choose)
  • Prices are listed in US dollars unless otherwise noted
  • Prices may change over time. Existing subscribers will be notified of price changes at least 30 days in advance
  • Founding-member or migration-cohort pricing, where offered, is locked for the duration of your continuous subscription. If you cancel and resubscribe later, you may not be eligible for the same pricing
  • You can change your billing frequency, update payment methods, or cancel through your account settings or via the Stripe Customer Portal

4.3 Cancellation

You can cancel your subscription at any time:

  • Cancellation takes effect at the end of your current billing period
  • You retain access to subscription features through the end of the period you've already paid for
  • We do not provide refunds for partial billing periods, except as required by law

4.4 Failed Payments

If a subscription payment fails:

  • We will automatically retry the payment up to 3 times via Stripe Smart Retries
  • If all retries fail, your subscription will be marked unpaid and subscription features will be locked
  • You can update your payment method at any time to restore access

4.5 One-Time Purchases

One-time purchases (such as The Oracle reading at $47 USD) are non-refundable except as described in Section 5 below or as required by law.

4.6 Taxes

You are responsible for any applicable taxes related to your purchases or subscriptions, except as otherwise required by law.

5. Refunds

5.1 Subscription Refunds

We do not provide refunds for subscription fees, except:

  • Where required by applicable law
  • For pro-rated cancellations during the first 7 days of a new subscription, on request

5.2 One-Time Purchase Refunds

For one-time digital products like The Oracle reading:

  • Due to the personalized nature of the product, all sales are generally final
  • We may issue refunds at our discretion for technical issues that prevent you from accessing your reading

5.3 How to Request a Refund

Contact us at hello@magickmaven.com within 7 days of purchase to request a refund. Include your order number and a brief explanation.

6. Acceptable Use

You agree NOT to:

  • Use our Services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our written permission
  • Use the Services in any way that could damage, disable, overburden, or impair our systems
  • Attempt to gain unauthorized access to any portion of the Services
  • Use any robot, spider, scraper, or other automated means to access the Services
  • Reverse engineer, decompile, or attempt to extract source code from our Services
  • Use the Brainstorm AI feature to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, discriminatory, or otherwise objectionable
  • Share your account credentials with others or allow others to use your account
  • Impersonate any person or entity
  • Interfere with other users' use of the Services

We reserve the right to suspend or terminate accounts that violate these terms, without notice or refund.

7. Intellectual Property

7.1 Our Content

All content provided through our Services — including text, graphics, logos, images, software, and the underlying frameworks of The Oracle — is owned by Krysta Francoeur or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, subject to these Terms.

7.2 Your Content

You retain ownership of any content you submit to our Services (such as your name, birth data, and Brainstorm conversations). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content as necessary to provide the Services.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Services, you agree we may use them without restriction or compensation to you.

8. AI-Generated Content

The Brainstorm feature uses artificial intelligence (currently powered by Anthropic's Claude) to generate responses to your input.

You acknowledge and agree that:

  • AI-generated responses are not professional advice
  • We do not guarantee the accuracy, completeness, or usefulness of AI responses
  • AI can produce inaccurate, biased, or unexpected output
  • You should use your own judgment when interpreting AI responses
  • AI responses are not a substitute for professional advice in medical, mental health, legal, financial, or other domains
  • We are not liable for any decisions you make based on AI-generated responses

9. Astrology, Human Design, and Gene Keys Disclaimers

Our Services include readings and interpretations based on astrology, Human Design, Gene Keys, and similar esoteric frameworks. You acknowledge that:

  • These frameworks are spiritual and personal-development tools, not science
  • Our content is for entertainment, reflection, and personal growth purposes only
  • We make no claims that our readings will predict the future, diagnose conditions, or guarantee specific outcomes
  • You should not rely on our content for medical, mental health, legal, financial, or other professional advice
  • Any decisions you make based on our content are your own responsibility

10. Third-Party Services

Our Services integrate with third-party services including Stripe, Shopify, Mailchimp, Anthropic, and others. Your use of these third-party services is subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimers and Limitation of Liability

11.1 Services Provided "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • The information provided will be accurate or reliable
  • Any defects will be corrected

11.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws

13. Termination

13.1 Termination by You

You can stop using our Services at any time. You can also cancel your subscription and/or close your account by contacting us at hello@magickmaven.com.

13.2 Termination by Us

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason — including violation of these Terms.

13.3 Effect of Termination

Upon termination:

  • Your right to access the Services ends
  • We may delete your account data, subject to legal retention requirements
  • Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply

14. Changes to These Terms

We may modify these Terms at any time. When we do:

  • We'll update the "Last Updated" date at the top of this page
  • For material changes, we'll provide notice via email or a prominent notice on our Services at least 14 days before the changes take effect
  • Continued use of our Services after changes means you accept the updated Terms

If you don't agree to updated Terms, you should stop using the Services.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services will be resolved through the courts of British Columbia, Canada, and you consent to the personal jurisdiction of those courts.

For users outside Canada, mandatory consumer protection laws of your country of residence may also apply.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.
